Despite careful content review, we accept no liability for external links to third-party content, as we did not initiate the transmission of this information, nor did we select or modify the recipient of the transmitted information or the transmitted information itself.

The protection of your personal data during collection, processing, and use on the occasion of your visit to our websites is an important concern for us and is carried out within the framework of legal regulations, about which you can inform yourself, for example, at https://www.dsb.gv.at/.

  • Description of the type of internet browser used and, if applicable, the operating system of your device as well as the name of your access provider,
  • Your browser history data as well as your standard web log information,

Our legitimate interest pursuant to Art. 6 Para. 1 S. 1 lit. f GDPR for collecting the data is based on the following purposes:

  • Ensuring a smooth connection setup and comfortable use of the website,
  • Evaluation of system security and stability, as well as
  • For other administrative purposes.

In no case do we use the collected data for the purpose of drawing conclusions about your person.

  1. b) When Using Our Contact Form

  • You have given your express consent to do so pursuant to (Art. 6 Para. 1 S. 1 lit. a GDPR),
  • This is necessary for the fulfillment of contractual relationships with you (Art. 6 Para. 1 lit. b GDPR),
  • There is a legal obligation to disclose (Art. 6 Para. 1 lit. c GDPR),
  • The disclosure is necessary for the assertion, exercise, or defense of legal claims and there is no reason to assume that you have an overriding legitimate interest in the non-disclosure of your data (Art. 6 Para. 1 S. 1 lit. f GDPR).

In these cases, the scope of the transmitted data is limited to the necessary minimum.

Our privacy policy is in accordance with applicable data protection regulations and the data is only processed in the Republic of Austria. No transmission to third countries takes place and is not intended.

  1. Data Subject Rights

The GDPR grants users (the so-called data subjects) various, partly new, rights. All of these must be listed, along with the legal basis, which is why this section is somewhat longer. Please read the rights carefully! The data subject has, among other things, the right to request at any time information about whether and which data is processed for what purpose and to whom it is disclosed on what basis. This also includes the right of the data subject to receive copies. Exception: In the case of large data volumes (e.g., social networks), users may be asked to specify the request for certain types of data. The information must be provided without delay and may in no case take longer than 1 month.

Upon request, we will be happy to inform you whether and which personal data about you is stored (Art. 15 GDPR), in particular about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected from us, as well as the existence of automated decision-making including profiling.

You also have the right to have any incorrectly collected personal data corrected or incompletely collected data completed (Art. 16 GDPR).

Furthermore, you have the right to request that we restrict the processing of your data, provided the legal requirements are met (Art. 18 GDPR).

You have the right to receive the personal data concerning you in a structured, commonly used, and machine-readable format or to request transmission to another controller (Art. 20 GDPR).

In addition, you have the so-called “right to be forgotten,” i.e., you can request that we delete your personal data, provided the legal requirements are met (Art. 17 GDPR).

Regardless of this, your personal data will be automatically deleted by us when the purpose of data collection no longer applies or the data processing was unlawful.

Pursuant to Art. 7 Para. 3 GDPR, you have the right to revoke your consent once given to us at any time. This has the consequence that we may no longer continue the data processing based on this consent for the future.

You also have the right to object at any time to the processing of your personal data, provided a right to object is legally provided. In the event of an effective revocation, your personal data will also be automatically deleted by us (Art. 21 GDPR).

If you wish to exercise your right of revocation or objection, an email to: info@thomatalerwirt.at is sufficient.

In the event of violations of data protection regulations, you have the option pursuant to Art. 77 GDPR to lodge a complaint with the competent supervisory authority, as well as any other supervisory authority.
The competent supervisory authority in Austria is the Data Protection Authority:

  1. Duration of Data Storage

The duration of storage of personal data is determined by the respective statutory retention period (e.g., commercial and tax retention periods). After expiration of the period, the corresponding data is routinely deleted, provided it is no longer required for contract fulfillment or contract initiation and/or we no longer have a legitimate interest in continued storage.

According to legal requirements in Austria, retention takes place in particular for 7 years pursuant to § 132 Para. 1 BAO (accounting documents, receipts/invoices, accounts, vouchers, business papers, statement of income and expenses, etc.), for 22 years in connection with real estate, and for 10 years for documents in connection with electronically provided services, telecommunications, broadcasting, and television services provided to non-entrepreneurs in EU member states and for which the Mini-One-Stop-Shop (MOSS) is used.
